Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1 Important Disclaimer
elyze is an independent third-party software and is not affiliated with, endorsed by, sponsored by, or in any way officially connected with Etsy, Inc. or any of its subsidiaries or affiliates. The name "Etsy" as well as related names, marks, emblems, and images are registered trademarks of their respective owners.
The Service is an analytics tool designed to assist sellers by analyzing publicly available data from the Etsy platform.
2 License Grant
Subject to your compliance with these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Service for your own internal business purposes.
The license is granted based on the subscription plan you purchase:
- Pro Plan (2 User Seats): Your license key may be active on up to two (2) devices at a time.
- Team Plan (3 User Seats): Your single license key may be active on up to three (3) devices simultaneously.
You agree not to share, sell, rent, or transfer your license key to any other individual or entity. We reserve the right to revoke your license immediately, without refund, if we detect license sharing or misuse.
3 Subscriptions, Payments, and Refunds
A. Billing
We offer monthly and annual subscription plans. By purchasing a plan, you agree to a recurring billing cycle. All payments are processed by our third-party payment processor, Lemon Squeezy. We do not store or have access to your full credit card details.
B. Subscription Cancellation
You may cancel your subscription at any time. Your access to the Service will continue until the end of your current billing period, after which it will cease.
C. Refund Policy
We offer a 7-Day Money-Back Guarantee. If you are not satisfied with the Service for any reason, you may request a full refund within seven (7) days of your initial purchase. This refund policy applies only to your first-time purchase and not to subsequent renewals.
D. Price Changes
We reserve the right to change our subscription plan prices at any time. We will provide you with reasonable prior notice of any price changes.
4 User Conduct and Responsibilities
You agree not to use the Service to:
- Reverse engineer, decompile, or otherwise attempt to discover the source code of the Extension.
- Use the Service in any way that violates the laws of your jurisdiction or the Terms of Service of Etsy, Inc.
- Distribute, sell, or share your license key or access to the Service.
- Use the Service to build a competitive product.
- Use any automated system (other than the features provided within the Service like "Auto Mode") to access or scrape data from Etsy in a manner that disrupts Etsy's services.
You acknowledge that you are solely responsible for your conduct while using the Service and for all business decisions you make based on the data provided.
5 Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the Service will be uninterrupted, error-free, secure, or that the data provided (including demand data, sales metrics, etc.) will be 100% accurate or complete.
Etsy may change its website or platform at any time, which may cause the Service to become temporarily or permanently inoperable. We will make reasonable efforts to provide updates, but we do not guarantee continuous functionality.
6 Limitation of Liability (Very Important)
IMPORTANT: Please read this section carefully.
To the maximum extent permitted by law, in no event shall elyze (or its owners, operators, or affiliates) be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to:
- Loss of profits, data, or revenue;
- Business interruption;
- Any negative action taken by Etsy, Inc. against your account (including, but not limited to, account warnings, suspension, or termination) as a result of your use of the Service or any other tool.
You expressly agree that you use the Service at your sole risk. Our total liability to you for any and all claims arising from your use of the Service is limited to the amount you paid to us in the twelve (12) months preceding the claim.
7 Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms (especially Section 2 or 4).
Upon termination, your right to use the Service will immediately cease.
8 Governing Law
These Terms shall be governed in accordance with applicable laws, without regard to conflict of law provisions.
9 Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
